in November, Trouble in Toyland, a toy safety report released by the U.S. PIRG Education Fund, noted that some of this year's recalled toys were still on sale and that toy safety was a concern. The report also cited cross-border e-commerce as flooding the market with fake toys and safety problems with new types of toys.

In October, the US PIRG Educational Foundation found 30 recalled toys for sale on Facebook and parts of eBay. It was able to purchase 11 of the toys, which had no safety warnings on its product pages.

According to relevant regulations, recalled products must be stopped from the sale (including resale transactions in the second-hand market). Just a few months ago, TJX Companies Inc was found guilty of violating this rule, Selling Fisher-Price Rock 'n Play Sleepers and Kids II Rocking Sleepers, recalled several years ago after they were linked to infant suffocation deaths, was fined a hefty $13 million.

Children's toys manufactured in the United States or imported into the United States after February 28, 2018, must meet the safety requirements of ASTM F963-17. In addition, toys intended for children 12 or younger must be tested by a third-party laboratory approved by the CPSC and certified in a children's product certificate as meeting federal toy safety standards set by Congress.

In the following three situations, toy companies shall cooperate with CPSC to recall products independently:

1) The reported product has security risks;

2) The toy company or CPSC receives reports of unsafe incidents and casualties caused by the products;

3) Failed in CPSC random check.

Although the system is beautiful, the recall is voluntary (i.e. by self-awareness), the CPSC makes an announcement, and the consumer contacts the toy company to return the product and refund the money. But unless the recall comes from a well-known brand (like Fisher-Price above) or the problem is so egregious that it is widely reported, how many consumers, or even businesses, will regularly check the website to avoid risk? So it's not surprising that recalled products are still on sale.
